COLLEGE NIL LAW · ALASKA · CHECKED OCTOBER 21, 2026 ·

College NIL law in Alaska.

Alaska has no college NIL statute, and no athlete agent act was found in its statutes. Campus policy, such as UAF's 10-business-day disclosure rule, fills the gap.

The short answer. Alaska has no college NIL statute. Phrase searches of the Legislature's own BASIS records (bills, statutes, journals and committee minutes) on 2026-10-21 found no bill using "image and likeness" from 1993 to 2026, and no statute or bill using "athlete agent" either, so no state registration applies to people who represent athletes in NIL deals; the federal Sports Agent Responsibility and Trust Act still does. What governs NIL at Alaska's universities is campus policy, for example University of Alaska Fairbanks Policy 09.09.024, which requires athletes to disclose NIL agreements within ten business days, plus NCAA rules.

The law

Alaska has no college NIL statute. In short: None (no athlete agent act found in the Alaska Statutes either). Rows drawn from a statute come from the enacted text on the legislature's own site; rows drawn from a school or board policy name that policy. Every source is linked under Sources, read on October 21, 2026.

What the Legislature has and has not done

No Alaska law on NIL for college athletes was found. Phrase searches of the Legislature's BASIS records on 2026-10-21 (bills, statutes, House and Senate journals, committee minutes and the Administrative Code) found no bill, statute or committee minute using "image and likeness" or "name, image, and likeness" between 1993 and 2026; the one journal hit is a 2016 House invocation quoting Genesis. A search for "student athlete" in bills from 2019 to 2026 returned two measures, neither about NIL (H.B. 173 on school climate and H.R. 9 on the rights of parents, teachers and students).

No athlete agent act found

No Alaska enactment of the Uniform Athlete Agents Act (2000) or the Revised Uniform Athlete Agents Act (2015) was found. Searches of the Alaska Statutes and of every bill, journal and committee minute in BASIS from 1993 to 2026 for "athlete agent", "athlete agents" or "sports agent" return nothing. So no state registration, state fee, required contract warning, state cancellation window, or Alaska duty to notify an athletic director when an athlete signs with an agent was found. The federal Sports Agent Responsibility and Trust Act of 2004 applies nationwide: it bars agents from giving false or misleading information, making false promises, providing anything of value to an athlete or anyone associated with the athlete before signing, or predating or postdating a contract, and requires a signed disclosure warning that signing may cost eligibility.

Campus policy at UAF

The University of Alaska Fairbanks adopted Policy 09.09.024 as an interim policy on 2024-09-11 and revised it on 2024-12-05; the chancellor signed it on 2025-01-29. It says it is meant to remain in place "until either the State of Alaska or the federal government enacts NIL legislation that would supersede the Policy." Its main rules:

  • disclosure of NIL activity and agreements within ten business days, and of changes within ten business days;
  • no "pay for play" by UAF or associated entities, and NIL pay at the going rate for similar services;
  • use of UAF facilities on the same terms as the public, and no use of UAF or University of Alaska marks without written permission;
  • no NIL activity during required athletics activities or while representing UAF, and no missed classes for NIL;
  • professional service providers allowed for NIL work only; and
  • a list of categories, from gambling and cannabis to pharmaceuticals and other colleges, in which UAF will not allow its marks to be used.

The policy also notes that accepting NIL pay in the United States may put an international student's visa at risk, and points international athletes to UAF's Office of International Student and Scholar Services or their own legal advisors.

Federal law

As of 2026-10-21, S. 4668 (Protect College Sports Act) passed the Senate 77-22 on 2026-09-28 and has been held at the House desk since 2026-10-05, with no later action in the Congress.gov bill status data on govinfo; it is not law. No Alaska NIL statute or athlete agent act was found, so § 121(a) has no Alaska statute to preempt and § 121(b)(1)(A)'s protection for "Uniform Athlete Agent Acts" has none to protect. If enacted as passed, the bill's NIL protections (§ 101(a)), school and collective pay (§ 101(c)) and right to representation (§ 101(d)) would apply in Alaska. Its deal-reporting duty is limited to schools "whose primary membership is in Division I" (§ 101(b)(5)); the NCAA lists UAF and UAA as Division II members. Its agent rules amend the Sports Agent Responsibility and Trust Act (§ 102): a cap of 5 percent of the value of an endorsement contract on agent fees, no agency contract past eligibility, and a requirement that an agent "register with a State" before representing a student athlete for an endorsement contract, which counts an agent "registered and certified under the All State Uniform Agent Acts in the State in which the agent operates" or registered with a professional league or players association. No Alaska registry was found.

What sits on top of it

How Leave fits

In Leave, every deal thread carries a rules summary for the athlete's state and level, and keeps the contract, its dates and the disclosure deadline that applies. It is a summary, not a ruling; the school and the statute decide. Leave is software, not an agent, and takes 0% of any deal. You decide, you send.

Questions about college NIL law in Alaska

Does Alaska have an NIL law in 2026?

No college NIL statute. Phrase searches of the Legislature's BASIS records (bills, statutes, journals and committee minutes) on 2026-10-21 found no bill using "image and likeness" from 1993 to 2026. NIL at Alaska's universities is governed by campus policy, such as University of Alaska Fairbanks Policy 09.09.024, and by NCAA rules.

Can Alaska colleges pay athletes directly?

No Alaska statute on it either way was found. Whether a University of Alaska campus pays athletes is a matter of NCAA rules and university decisions. UAF's policy says NIL may not be used to pay athletes for athletic performance ("no pay for play") and that NIL pay must match the going rate for similar services in the relevant market.

Do I have to tell my school about an NIL deal in Alaska?

No Alaska statute requiring it was found, but school policy can. UAF Policy 09.09.024 requires athletes to disclose NIL activity and any related agreement within ten business days, and to report changes within ten business days, through the athletics department's disclosure process.

Does Alaska require an NIL agent to be licensed?

No Alaska requirement was found. A search of the Alaska Statutes and of bills since 1993 found no athlete agent act, so there is no state registration or license for anyone representing athletes, in NIL or in professional contracts. The federal Sports Agent Responsibility and Trust Act still applies to agents nationwide. UAF policy allows athletes to use marketing agents and brand managers for NIL work only.

Are NIL contracts public records at the University of Alaska?

No statute answers that directly. AS 40.25.110 opens the records of all public agencies, including the University of Alaska, unless an exception applies, and none of the exceptions in AS 40.25.120 names NIL contracts. The exceptions do cover records kept confidential by federal or state law and FERPA-protected education records.
