Delaware NIL rules.

Delaware's 2026 NIL policy sends deals of $600 or more to NIL Go, smaller ones to INFLCR. UD opted into revenue sharing; in 2025 it said it would not spend the full cap.

The short answer. Delaware Athletics' NIL Policy (updated August 2026) says all third-party NIL agreements worth $600 or more "must be reported to NIL Go within five business days of execution or agreement on payment terms", and that deals under $600 "should be disclosed through Teamworks Influencer (INFLCR)". UD's House settlement page says "All full-time members of Conference USA are opting into the House settlement" and, asked whether Delaware will spend up to that year's $20.5 million cap, answers "Not at this time". The College Sports Commission puts the 2026-27 cap at approximately $21.58 million per school. Delaware has no general college NIL statute; its athlete-agent law covers agents on NIL deals (/nil/college/delaware).

School NIL policyDelaware Athletics NIL Policy, "Updated August 2026" (posted 2026-09-08). It applies to all student-athletes from initial full-time enrollment or the start of official practice, whichever comes first. It bars NIL activity during "countable related activities" and during official team activities without prior approval, bars deals with direct competitors of nine named university partners unless the university approves, bars pay for athletic performance or specific athletic achievement, and lists penalties including verbal or written reprimand, loss of practice or competition privileges, suspension or dismissal from the program, loss of NCAA eligibility and loss of athletic aidDelaware Athletics NIL Policy (August 2026)
How deals are disclosedNIL Go for third-party deals of $600 or more within five business days (NCAA Bylaws 22.2.2, 22.2.2.2). UD's policy repeats that rule, adds "Deals must be cleared to confirm compliance with the rules and protect the student-athlete's eligibility", lets each athlete designate one representative to enter deals in NIL Go for the athlete to submit, and says athletes "should report the NIL activities to the athletics department through the proper channels in advance of participating". Deals under $600 "should be disclosed" through INFLCR; if there is an issue, UD tells the athlete, who may try to renegotiate, and a revised proposal "must be resubmitted through INFLCR for approval"Delaware Athletics NIL Policy (August 2026); NCAA Division I Manual 2026-27
Banned categoriesDelaware has no statutory list. UD's policy bars NIL activity involving NCAA banned substances; a seller or dispensary of a controlled substance, including marijuana; casinos or any entity that sponsors or promotes sports gambling activity, "including prediction markets"; alcohol or sellers of alcohol; tobacco, alternative nicotine and vape products and specialty retailers; and adult entertainment businesses. It also bars activity that in UD's "good faith judgment" reflects adversely on the university, and, unless the university approves, deals with direct competitors of the third parties UD has a partnership with in nine categories: orthopaedic (DOS), health care system (ChristianaCare), health insurance (Highmark), sportswear apparel (Adidas), soft drink (Pepsi), sports drink (Gatorade), protein drinks (Muscle Milk), dance studio (Radiance Dance Studio) and copiers (Digital Office Solutions)Delaware Athletics NIL Policy (August 2026); /nil/college/delaware
School marks and group licensingAthletes may say they play their sport "at University of Delaware" and may use photos of themselves in uniform "from game competition only" or photos provided by UD Athletics; any other use of the university's name, logo or marks needs advance approval under UD's Trademark Licensing policy. Licensed apparel and retail products go through the Collegiate Licensing Company. UD's NIL page says its NIL merchandise partnership with Athlete's Thread placed Delaware among the top 25 schools in annual merchandise sales across that company's network. UD's House settlement page (June 2025) says schools opting in "like Delaware, will choose the amount they share with student-athletes", answers "Not at this time" to whether Delaware will spend up to that year's $20.5 million cap, and says the amount shared "will be approximately proportional with how external revenue comes in". What is specific to Delaware

Delaware became a full member of Conference USA on 2025-07-01 and began its first FBS football season. Its August 2026 NIL policy names Conference USA and NCAA rules, sends deals of $600 or more to NIL Go and smaller ones to INFLCR, and its gambling bar reaches any entity that sponsors or promotes sports gambling activity "including prediction markets". It also names the nine partners whose direct competitors are off limits unless the university approves: DOS, ChristianaCare, Highmark, Adidas, Pepsi, Gatorade, Muscle Milk, Radiance Dance Studio and Digital Office Solutions. On money from the school side, UD set up the Student-Athlete Excellence Fund so coaches, with a program general manager or sport administrator, can "provide NIL payments to student-athletes", and runs an athlete merchandise program with Athlete's Thread.

How Leave fits

In Leave, every deal thread carries a rules summary for the athlete's state and level, and keeps the contract, its dates and the disclosure deadline that applies. It is a summary, not a ruling; the school and the law decide. Leave is software, not an agent, and takes 0% of any deal. You decide, you send.

Questions about NIL at Delaware

Does Delaware pay its athletes?

Delaware opted into the House settlement; its June 2025 page says all full-time Conference USA members were opting in and answered "Not at this time" to whether Delaware would spend up to that year's $20.5 million cap. The College Sports Commission lists the University of Delaware for 2026-27, with a cap of approximately $21.58 million per school. UD has not published a total. Separately, its Student-Athlete Excellence Fund lets coaches provide NIL payments.

How do Delaware athletes report NIL deals?

Under UD's August 2026 policy, third-party deals worth $600 or more go to NIL Go within five business days of signing or agreeing on payment terms, and deals under $600 are disclosed through INFLCR. The policy also asks athletes to report NIL activities to the athletics department before taking part.

What can't Delaware athletes promote?

UD's policy bars NIL activity involving NCAA banned substances, sellers or dispensaries of controlled substances including marijuana, casinos or any entity that sponsors or promotes sports gambling activity "including prediction markets", alcohol, tobacco and vaping products, and adult entertainment. Unless the university approves, it also bars deals with direct competitors of DOS, ChristianaCare, Highmark, Adidas, Pepsi, Gatorade, Muscle Milk, Radiance Dance Studio and Digital Office Solutions.

Can Delaware athletes use the Blue Hens logo in NIL deals?

Only with advance approval under UD's Trademark Licensing policy. Without approval, athletes may say they play their sport at the University of Delaware and use game photos of themselves in uniform or photos UD Athletics provides.

Is there an NIL collective for Delaware?

UD does not name a collective. It points donors to its own Student-Athlete Excellence Fund, which coaches can use for NIL payments, and points businesses to the Blue Hen Exchange and a Delaware NIL Interest Form run by UD Athletics staff.
