The rules at Duquesne
| Question | What is published | Source |
|---|---|---|
| School NIL policy | "Duquesne University Athletics Policy on Student-Athlete Name, Image, and Likeness", posted 2022-07-12 (file named for 2022-07-01) and summarized on the athletics NIL page. Athletes may receive pay "commensurate with fair market value" for NIL, not "in exchange, in whole or in part" for attending, participating or performing; NIL pay does not affect athletics aid; Duquesne will educate athletes and may "identify and/or facilitate" opportunities but "will not negotiate or advocate" for them; athletes may not miss class or required team activities. Facility use for NIL needs a written request at least seven business days ahead. Violations are decided by Athletics Compliance with the Athletics Director and the Office of Legal Affairs, with appeal through the Athletics appeal process | Duquesne Athletics, NIL Policy (posted 2022-07-12) and NIL page |
| How deals are disclosed | NCAA: third-party deals of $600 or more go to NIL Go within five business days (Bylaws 22.2.2, 22.2.2.2). Duquesne's policy: an athlete "who proposes to enter into a written or oral contract providing compensation for the use of their NIL shall disclose the contract to the Athletics Compliance office at least seven (7) days prior to signing and/or executing the contract", on the Disclosure Form, with copies of the contracts; the form (2022-04-22) cites "Pennsylvania law (PA Senate Bill No. 381)" as the source. Pennsylvania law has made disclosure to the school optional ("may") since 2024 while letting schools set disclosure policies | Duquesne Athletics, NIL Policy (2022) and NIL Disclosure Form (2022-04-22); NCAA Division I Manual 2026-27; /nil/college/pennsylvania |
| Banned categories | Pennsylvania law and Duquesne's policy bar NIL pay tied to adult entertainment products and services; alcohol products; casinos and gambling, including sports betting, the lottery and betting on video, online and mobile games; tobacco and electronic smoking products and devices; prescription pharmaceuticals; and controlled dangerous substances. Duquesne also bars NIL activity that conflicts with sponsorships in place when the athlete discloses, and any NIL activity "that conflict[s] with the University's mission and institutional values". Newer sponsors include Gecko Robotics, named "Official AI & Robotics Partner" with a patch on men's basketball jerseys (2026-10-05), and SteelPoint Capital, on football jerseys and helmets under a five-year deal (2026-10-20) | Duquesne Athletics, NIL Policy (2022), Gecko Robotics release (2026-10-05) and SteelPoint Capital release (2026-10-20); /nil/college/pennsylvania |
| School marks and group licensing | Athletes may say they play their sport "at (Duquesne University)", but "no Duquesne Student-Athlete may use a Duquesne Mark or Duquesne Gear in NIL Activities without the advance written approval of Duquesne", which is not required to approve. A separate policy on use of Duquesne intellectual property (posted 2022-07-12) sets three steps: initial review through the NIL Disclosure Form, conditional approval within seven days (automatic for deals with current corporate partners), then final written approval. A brand making products with Duquesne marks must become officially licensed, with products reviewed through Collegiate Licensing Company, and the policy says such products carry "the standard royalty rate at the time of production (12%)", a fee the brand pays Athletics on total sales that "is not paid by the Duquesne Student-Athlete"; current corporate partners pay no added royalty, and other brands may owe more. The marks may not be used for a brand competing with a Duquesne contract partner. The Duquesne NIL Store, run by Campus Ink, opened on 2023-07-13 with merchandise "officially licensed by Duquesne University" | Duquesne Athletics, NIL Policy and Intellectual Property policy (2022-07-12); NIL Store release (2023-07-13) |
| Revenue sharing | The College Sports Commission lists Duquesne University as participating in 2026-27 and puts the cap at "approximately $21.58 million per school" (read 2026-10-23). Not published by Duquesne: no revenue-sharing statement or allocation was found on its athletics site, and its 2022 NIL policy predates school payments | College Sports Commission |
| Collective or NIL group | Red and Blue Collective. In a letter posted 2023-03-08, then Vice President of Athletics Dave Harper announced that supporters were "formally launching the 'Red and Blue Collective'", with day-to-day operations through the agency Student Athlete NIL (SANIL), and named a collective website. On 2026-10-23 that web address did not resolve, and no newer Duquesne statement on the collective was found; its current status was not confirmed | Duquesne Athletics, Red and Blue Collective letter (2023-03-08) |
| Agents and representation | Duquesne's policy says it will not penalize athletes for NIL representation and that "Pennsylvania law requires" representation from a registered athlete agent, a financial advisor acting under Pennsylvania law, or a Pennsylvania lawyer. Current Pennsylvania law limits NIL representation to athlete agents registered under 5 Pa.C.S. Ch. 35 (State Athletic Commission) and Pennsylvania lawyers, bars schools from interfering with NIL representation, and requires an NIL agent contract to state it does not bind the athlete beyond NIL | Duquesne Athletics, NIL Policy (2022); /nil/college/pennsylvania |
| Compliance contact | Duquesne University Athletics Compliance Office, compliance@duq.edu | Duquesne Athletics, Compliance |
| State law | In force. Pennsylvania's Article XX-M (Act 89 of 2024) covers private colleges chartered in Pennsylvania, makes disclosure to the school optional, bars six product categories and limits NIL representation to registered athlete agents and Pennsylvania lawyers | /nil/college/pennsylvania |
What is specific to Duquesne
Duquesne writes its NIL limits in Spiritan terms: the policy calls Duquesne "a private, Catholic institution founded in the Spiritan tradition" and bars NIL activity that conflicts with that mission, on top of Pennsylvania's six categories. Its rules on logos read like a licensing contract, with a three-step approval and a royalty rate written into the policy: the brand behind a product with Duquesne marks becomes an official licensee and pays the royalty, not the athlete. Duquesne's compliance page calls it "a member of the Atlantic 10 and Northeast Conferences", and its NIL policy names both. Leadership changed in 2026: Harper, who signed the 2023 Red and Blue Collective letter, left for Baylor, and Senior Associate Athletic Director John Henderson was named interim athletic director from early May 2026 (announced 2026-03-31); Duquesne releases still called him interim director of athletics on 2026-10-20.
How Leave fits
In Leave, every deal thread carries a rules summary for the athlete's state and level, and keeps the contract, its dates and the disclosure deadline that applies. It is a summary, not a ruling; the school and the law decide. Leave is software, not an agent, and takes 0% of any deal. You decide, you send.
Questions about NIL at Duquesne
Does Duquesne pay its athletes?
Duquesne is on the College Sports Commission's list of revenue-sharing schools for 2026-27, with a cap of about $21.58 million per school. Duquesne has not published a revenue-sharing statement or breakdown on its athletics site, and its posted NIL policy dates from 2022.
What NIL collective works with Duquesne?
Duquesne Athletics announced the Red and Blue Collective in a letter posted 2023-03-08, run with the agency Student Athlete NIL. The collective's web address in that letter did not resolve on 2026-10-23, and no newer Duquesne statement was found, so its current status is not confirmed.
How do Duquesne athletes report NIL deals?
Duquesne's 2022 policy asks athletes to submit the NIL Disclosure Form to Athletics Compliance at least seven days before signing, with copies of the contract. NCAA Bylaws 22.2.2 and 22.2.2.2 separately call for reporting third-party deals of $600 or more to NIL Go within five business days.
Can Duquesne athletes use Duquesne logos in NIL deals?
Only with Duquesne's advance written approval, which Duquesne is not required to give. Its 2022 intellectual property policy sets a three-step process, with automatic conditional approval for deals with current Duquesne corporate partners. A brand selling products with Duquesne marks must be officially licensed and pays Duquesne a royalty the policy gives as 12%; the policy says the athlete does not pay it.
Does Pennsylvania NIL law cover Duquesne athletes?
Yes. Pennsylvania's Article XX-M covers private colleges chartered in the state. It bars six product categories, makes disclosure to the school optional while letting schools set their own disclosure rules, and limits NIL representation to registered athlete agents and Pennsylvania lawyers.
