The rules at Florida Atlantic
| Question | What is published | Source |
|---|---|---|
| School NIL policy | Two FAU texts are posted. The 2026-27 Student-Athlete Handbook (posted 2026-07-01, same NIL text as 2025-26) lists what athletes may and may not do and what staff may do. The "Florida Atlantic University Student-Athlete NIL Policy" (posted 2021-07-01, file dated 2021-09-14), written under Florida's 2020 law, covers pay rules, agents, service providers, institutional involvement, financial literacy, marks, boosters and disclosure; it says pay "may only be provided by a third party unaffiliated with FAU" | FAU Athletics, Student-Athlete Handbook 2026-27 and Student-Athlete NIL Policy (2021) |
| How deals are disclosed | Handbook: athletes "disclose all NIL activity through FAU's Disclosure platform". The 2021 policy asks athletes to disclose "any oral or written arrangements or agreement" with contract terms, pay and services, and to update FAU within 14 days of a change. NCAA: third-party deals of $600 or more go to NIL Go within five business days (Bylaws 22.2.2, 22.2.2.2). Florida's statute no longer has a disclosure rule since 2023 | FAU Athletics, Student-Athlete Handbook 2026-27 and Student-Athlete NIL Policy (2021); NCAA Division I Manual 2026-27; /nil/college/florida |
| Banned categories | Florida's statute lists none. FAU's 2021 policy says FAU may prohibit NIL activity that conflicts with its values, code of conduct or team policy, and lists "Alcohol (if under 21)", "Tobacco products and drugs", "Gambling" and "Adult entertainment"; it also lets FAU prohibit deals that conflict with institutional sponsorships, disclosing the conflicting terms. The handbook bars selling any item received through FAU Athletics | FAU Athletics, Student-Athlete NIL Policy (2021) and Student-Athlete Handbook 2026-27; /nil/college/florida |
| School marks and group licensing | Handbook: athletes may not "Use FAU, Conference or NCAA marks or facilities in any NIL activity without prior express written permission", and "Student-athletes and sponsoring parties pay going rate for all institutional trademarks/facilities used". The 2021 policy requires a written agreement with FAU for any use of its marks, "This includes appearances in a team uniform or university apparel", and written approval from FAU's Division of Public Affairs for facilities. FAU's Competitive Excellence Fund page links three athlete merchandise providers (Athletes Thread, Campus Ink, Influxer) and says "Individual athletes work directly with the providers"; no FAU group licensing terms are published | FAU Athletics, Student-Athlete Handbook 2026-27, Student-Athlete NIL Policy (2021) and Competitive Excellence Fund page |
| Revenue sharing | The College Sports Commission puts the 2026-27 cap at approximately $21.58 million per school and lists Florida Atlantic University as participating in 2026-27. Brian White, then Vice President and Director of Athletics, said on 2025-06-08 that "university leadership has been strategically preparing for FAU to remain competitive in revenue sharing with our student-athletes", as FAU launched the Competitive Excellence Fund for tax-deductible gifts. On 2025-06-27 FAU said its Board of Trustees approved an annual allocation of auxiliary funds to that fund, "an average of $5 million per year". White left for Virginia Tech in June 2026; FAU's 2026-10-02 release names Josh McCowan as Vice President and Director of Athletics. FAU has not published a 2026-27 revenue-sharing total or its division by sport | College Sports Commission; FAU Athletics, Competitive Excellence Fund releases (2025-06-08, 2025-06-27) and athletics director releases (2026-06-23, 2026-10-02) |
| Collective or NIL group | FAU's NIL in Paradise page (read 2026-10-23) says "NIL in Paradise is the official collective for Florida Atlantic" and that donated funds "are used to engage student-athletes in Name, Image and Likeness (NIL) opportunities supporting local businesses and organizations". The nilinparadise.com address redirected to TheLinkU's FAU donation page that day; FAU announced its TheLinkU arrangement on 2023-09-08. The same page links the Owls' Opendorse marketplace, launched 2022-11-08 | FAU Athletics, NIL in Paradise page and TheLinkU release (2023-09-08) |
| Agents and representation | The 2021 policy says FAU "will not prevent or unduly restrict" NIL representation, that an NIL agent "must be licensed in the state of Florida" and an attorney a member in good standing of The Florida Bar, that FAU employees may not act as an athlete's NIL service provider, and that representation contracts may not run past the athlete's participation. FAU's Agents page says an Agent-Advisor Registration "should be completed and forwarded" to compliance "prior to student-athlete contact". The handbook bars hiring an agent for professional athletic representation "(as opposed to only marketing representation)". Florida law requires a Florida athlete agent license for NIL representation (s. 468.453(8)) | FAU Athletics, Student-Athlete NIL Policy (2021), Agents page and Student-Athlete Handbook 2026-27; /nil/college/florida |
| Compliance contact | FAU Athletics Compliance; Garrett Franskousky, Senior Associate AD for Compliance, 561-297-0756, gfransko@fau.edu | FAU Athletics, Staff Directory and Compliance page |
| State law | In force. Florida's s. 1006.74, cut back in 2023, now requires two financial literacy and life skills workshops of at least 5 hours each before graduation and shields schools from damages over routine athletics decisions, with Board of Governors Regulation 6.022 applying both to state universities like FAU; s. 468.453(8) requires a Florida license for NIL agents | /nil/college/florida |
What is specific to Florida Atlantic
FAU's athlete rules show two eras side by side. The 2021 policy, written when Florida law barred school and booster pay, says FAU and any entity supporting it "will not compensate or cause compensation to be directed" to athletes for NIL and that FAU will not help identify deals unless the service is open to the public. The 2026-27 handbook lets FAU staff "Seek NIL opportunities for current student-athletes" and "Connect current student-athletes to NIL opportunities", and Brian White, then athletic director, said in June 2025 that FAU "embraced Name, Image and Likeness from its inception" while opening the Competitive Excellence Fund for the revenue-sharing era; weeks later the university committed auxiliary funds to that fund. FAU's compliance page also describes it as a member of three conferences: the American, Conference USA for beach volleyball and the ASUN for men's swimming and diving.
How Leave fits
In Leave, every deal thread carries a rules summary for the athlete's state and level, and keeps the contract, its dates and the disclosure deadline that applies. It is a summary, not a ruling; the school and the law decide. Leave is software, not an agent, and takes 0% of any deal. You decide, you send.
Questions about NIL at Florida Atlantic
Does Florida Atlantic pay its athletes?
The College Sports Commission lists FAU as participating in 2026-27 revenue sharing, with a cap of approximately $21.58 million per school, and Brian White, then athletic director, said in June 2025 that FAU had prepared "to remain competitive in revenue sharing". FAU has not published how much it shares with athletes or how it divides the money.
How do FAU athletes report NIL deals?
FAU's 2026-27 handbook says athletes disclose all NIL activity through FAU's disclosure platform. Under NCAA Bylaws 22.2.2 and 22.2.2.2, third-party deals of $600 or more also go to NIL Go within five business days.
What NIL collective works with Florida Atlantic?
FAU's NIL in Paradise page calls NIL in Paradise "the official collective for Florida Atlantic", with donations used for NIL work with local businesses and organizations; its web address led to TheLinkU's FAU page on 2026-10-23. FAU also links an Opendorse marketplace for direct deals.
Does an FAU athlete's NIL agent need a Florida license?
Florida law requires a Florida athlete agent license to represent a college athlete on NIL contracts (s. 468.453(8)), and FAU's 2021 policy says the same; an attorney must be a member in good standing of The Florida Bar. FAU also asks agents to register with its compliance office before contact.
Can FAU athletes use the Owls logo in NIL deals?
Only with prior express written permission, and the handbook says athletes and sponsors pay the going rate for FAU trademarks and facilities used. The 2021 policy counts appearing in a team uniform or university apparel as use of FAU marks.
